It does not create a new maximum. Must not be rendered as a standalone penalty card.

Note on this entry

Last verified 2026-10-19. Summary branches with no separate maximum fall under s. 787(1): fine $0–$5,000 and/or imprisonment 0–2 years less a day (2019, c. 25, s. 316). ss. 320 and 320.1 are seizure/forfeiture procedures for hate propaganda, not offences — no imprisonment or fine; s. 319(4) allows forfeiture of instruments of the offence on conviction, in addition to any other punishment. Combatting Hate Act (S.C. 2026, c. 15; Bill C-9) received Royal Assent 18 June 2026 and came into force 18 July 2026 (Justice Canada); it added ss. 319(2.2)–(2.3), 320.1001 and 423.3, defined 'hatred' in s. 319(7), and repealed the s. 319(3)(b)/s. 319(3.1)(b) religious-opinion defences. Version caveat: laws-lois pages showed inconsistent currency during research (one page current to 2025-03-03, another incorporating the 2026 amendments) — re-check live consolidated text before launch.
