Simple battery is the separate offence in § 16-5-23 (intentionally making physical contact of an insulting or provoking nature, or intentionally causing physical harm), punished the same way: misdemeanour, or misdemeanour of a high and aggravated nature for the same protected categories (65+/pregnant victim, public transit, police/correction/detention officer, household/family members, sports official). The former 65-years-or-older high-and-aggravated tier in § 16-5-20 was repealed in 2021 — subsection (e) is now Reserved — so no 65+ tier is listed for simple assault itself.

Any felony between household members = family violence (§ 19-13-1(1)) Possibly — unconfirmed
- Imprisonment
- Per underlying felony statute
- Fine
- Per underlying felony statute
Designation only — the penalty comes from the underlying offence (e.g. aggravated assault, 3–20 years). Family violence also includes the listed misdemeanours (battery, simple battery, simple assault, assault, stalking, criminal damage to property, unlawful restraint, criminal trespass) between household members (§ 19-13-1(2)).
A suggested § 16-5-90 provision does not define family violence — § 16-5-90 is stalking, a different offence not covered here. 'Household members' = past or present spouses, persons who are parents of the same child, parents and children, stepparents and stepchildren, foster parents and foster children, or other persons living or formerly living in the same household. Civil family-violence protective orders (Title 19, Chapter 13) and criminal protective-order / no-contact conditions are not penalties and are not covered here. Stalking / aggravated stalking (§§ 16-5-90, 16-5-91) are not covered here.

- $0–$1,000 (via O.C.G.A. § 17-10-3)
Death caused without intent by a lawful act done in an unlawful manner likely to cause death or great bodily harm. Misdemeanour.
Correction to the brief: voluntary manslaughter is O.C.G.A. § 16-5-2; § 16-5-3 is involuntary manslaughter only. Voluntary manslaughter is a killing under circumstances which would otherwise be murder, done solely as the result of a sudden, violent and irresistible passion from serious provocation; if there was an interval sufficient for the voice of reason and humanity to be heard, the killing is attributed to deliberate revenge and punished as murder (§ 16-5-2(a)). §§ 16-5-2 and 16-5-3 state no fine; the fines shown come from §§ 17-10-8 and 17-10-3. Vehicular homicide (§ 40-6-393) is a separate offence and is not covered here.
Homicide — murder Possibly — unconfirmed

Georgia has no degrees of murder beyond murder and murder in the second degree; felony murder is murder under § 16-5-1(c), not a separate degree. Death may be imposed only if the sentencer finds at least one § 17-10-30(b) statutory aggravating circumstance beyond a reasonable doubt. § 17-10-30(a) also allows death for aircraft hijacking and treason. Serious-violent-felony sentencing (§ 17-10-6.1) applies to murder. § 16-5-1 states no fine.

- Fine
- No fine stated in § 16-6-5.1(h)
Electronic monitoring required as a condition of probation.
The death penalty listed for rape in § 16-6-1(b) is unenforceable: the US Supreme Court barred the death penalty for the rape of an adult (Coker v. Georgia, 1977) and for the rape of a child where the crime did not result in death (Kennedy v. Louisiana, 2008). § 16-6-5.1 was retitled in 2019 from 'sexual assault' to 'improper sexual contact by employee, agent, or foster parent'; consent is not a defence under § 16-6-5.1(d). Sexual-offender sentencing (§ 17-10-6.2) and registration apply to these offences. The close-in-age misdemeanour exception (§ 16-6-5.1(f)(2)(A), (g)(2)) is not tiered here.

The court may depart from the mandatory minimum only if all five § 16-13-31(g)(2)(A) conditions are met (not a leader, no firearm/dangerous weapon, no death/serious injury to a non-participant, no prior felony, interests of justice), within the reduced ranges in § 16-13-31(g)(2)(B); the district attorney may also move for a reduced/suspended sentence for substantial assistance (§ 16-13-31(g)(1)). Fentanyl trafficking is in § 16-13-31(b.1); a separate § 16-13-31.1 fentanyl provision was not confirmed. Sale/manufacture below trafficking thresholds falls under § 16-13-30(b) (5–30 years; second or subsequent 10–40 years or life).
